Warranty Disclaimer 

Knox Elements Inc. warrants that this Knox Elements Inc. Product (the "Product") will be free from defects in material and workmanship for a period of one year from its date of purchase.  This warranty is subject to the conditions, exclusions and limitations outlined below.

The warranty applies to the original owner of the Product and is non-transferable. Knox Elements Inc. obligation does not extend to damages resulting from (1) assembly, operation, or maintenance of the Product; (2) installation or use which does not comply with local building codes and ordinances; (3) shipping, improper handling, improper operation, misuse, or abuse; (4) modification of the Product not expressly authorized and approved in writing by Knox Elements Inc.  Any of the circumstances described in the previous sentence voids this warranty. This warranty is void if the Product or any component has been removed , repaired, or replaced before Knox Elements has been afforded reasonable opportunity to inspect the Product.

This warranty is limited to the replacement or repair of defective components or workmanship and Knox Elements Inc. may fully discharge its obligation under this warranty by repairing or replacing, at its discretion, the defective components. Knox Elements Inc. will provide replacement parts at no charge and will pay reasonable and necessary labor and freight costs related to replacing and repairing defective components under this warranty. The maximum amount recoverable under this warranty is limited to the purchase price of the Product and, if Knox Elements Inc. is unable to provide replacement or repair in an expedient and cost-effective manner, Knox Elements Inc. may discharge all obligations under this warranty by refunding the purchase price of the Product.

EXCEPT TO THE EXTEND PROVIDED BY LAW, KNOX ELEMENTS INC. MAKES NO EXPRESS WARRANTIES OTHER THAN THE WARRANTY EXPRESS HEREIN. THE DURATION OF ANY IMPLIED WARRANTY IS LIMITED TO THE DURATION OF THE WARRANTY SPECIFIED ABOVE. IN NO EVENT SHALL KNOX ELEMENTS INC. BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY DEFECTS IN THE PRODUCT.

To obtain service under this warranty you must:

1. Send written notice of the claimed condition to: Knox Elements Inc., 685 West 600 North, North Salt Lake, Utah 84054.

2. Affirm you are the original owner of the product.

3. Provide Knox Elements Inc. with reasonable opportunity to investigate the claim, including reasonable opportunity to inspect the Product prior to any repair or replacement work and before the Product or any component of the Product has been removed.

Limitation of Liability

Knox Elements Inc. does not and shall not assume any liability whatsoever for use of, or defects which may be claimed in, any products sold or distributed by Knox Elements Inc. (the “Products”) on knoxelements.com (the “Site”). With regard to communication with Knox Elements Inc.’s technical sales staff, it is agreed and acknowledged that Knox Elements Inc.’s technical sales staff is only provided to assist in the identification of the Products. Knox Elements Inc.’s technical sales staff does not and shall not assume any responsibility or liability whatsoever relating to the installation or use of any Products. The customer is advised to seek the assistance of a qualified licensed installer to ensure the proper selection and installation of any of the Products and compliance with local codes and ordinances. Knox Elements Inc. expressly disclaims and shall not be liable for any claims for damage, injury, cost or expense suffered or incurred as a result of or otherwise caused by the installation or use of any of the Products. The customer shall indemnify, defend and hold harmless Knox Elements Inc. and its employees, officers, directors, owners and agents, from and against any such claims for damage, injury, cost or expense suffered or incurred as a result of, caused by or otherwise related to the installation or use of the any Products purchased by the customer.
